PERSONAL DATA PROTECTION (KVKK) – INFORMATION NOTICE

This Information Notice has been prepared by HİD-TEK MAKİNA SANAYİ VE TİCARET LİMİTED ŞİRKETİ (hereinafter referred to as “HİD-TEK”), acting in its capacity as the Data Controller, in accordance with Article 10 of the Law No. 6698 on the Protection of Personal Data (“Law”), titled “Obligation of the Data Controller to Inform,” regarding your personal data collected, stored, and processed by other means. Our company implements the necessary technical and administrative measures to ensure that your personal data is securely maintained and processed in compliance with Law No. 6698.

As HİD-TEK, we would like to inform you about our communication practices, our processes regarding the processing of your personal data, and your rights under the Law on the Protection of Personal Data.

Who is responsible for your personal data? (Data Controller)
As HİD-TEK (referring to Hid-Tek Makina Sanayi ve Ticaret Limited Şirketi and its existing and/or prospective domestic and international affiliates, distributors, subsidiaries, joint ventures, and all their branches and offices), we process your personal data in our capacity as the “Data Controller” as defined under Law No. 6698, in accordance with the applicable legislation and within the limits prescribed by law, as explained below.

1. Collection, Processing and Purposes of Personal Data

Your personal data may vary depending on the services provided by HİD-TEK and its commercial activities; however, it may be collected through automated or non-automated methods, verbally, in writing, or electronically via HİD-TEK departments and offices, website, social media platforms, mobile applications, and similar channels. While you benefit from HİD-TEK’s products and services, your personal data may be processed by being generated and updated accordingly.

In addition, your personal data may be processed when you use our call centers or website for the purpose of accessing HİD-TEK services, when you visit HİD-TEK or our website, and when you participate in events and organizations organized by HİD-TEK.

Video recordings are collected in our workplace for the purposes of ensuring security, monitoring work processes, and for other legal reasons, and are stored for a maximum period of one (1) month. These recordings will not be used for any purpose other than security and will only be shared with authorized public authorities when necessary.
The personal data obtained in this manner is also processed within the framework of the Law on the Protection of Personal Data (KVKK). Article 5 of the KVKK sets out the conditions for processing personal data, and in cases where explicit consent is required under the law, your explicit consent will be obtained.
However, provided that the conditions set out in Article 5, Paragraph 2 of the KVKK are met, it is possible to process personal data without the explicit consent of the data subject. In this context, HİD-TEK may process such personal data without obtaining explicit consent, as the purpose is to ensure company security and control entry and exit movements.

Your collected personal data will be processed for the purposes of enabling you to benefit from the products and services offered by HİD-TEK through the necessary activities carried out by our business units, recommending and customizing HİD-TEK’s products and services in line with your preferences, usage habits, and needs, and ensuring the legal and commercial security of HİD-TEK and the individuals who have business relationships with HİD-TEK.

2. To Whom and for What Purposes Processed Personal Data May Be Transferred

Your collected personal data may be transferred, within the scope of the personal data processing conditions and purposes set out in Articles 8 and 9 of the KVKK, to our business partners, suppliers, cargo/transportation/logistics companies for the purpose of product delivery, our shareholders, and legally authorized public institutions and private entities; for the purposes of enabling you to benefit from the products and services offered by HİD-TEK through necessary activities carried out by our business units, recommending HİD-TEK’s products and services by customizing them according to your preferences, usage habits, and needs, ensuring the legal and commercial security of HİD-TEK and persons in business relationship with HİD-TEK, and determining and implementing HİD-TEK’s commercial and business strategies.

3. Method and Legal Basis for Collecting Personal Data

Your personal data is collected in all kinds of verbal, written, or electronic environments, for the purposes stated above, in order to ensure that the products and services offered by the Company are provided within the defined legal framework and to enable the Company to fully and properly fulfill its contractual and legal obligations. As also stated above, data is collected via surveillance cameras for the purposes of ensuring workplace security and monitoring business operations. Your personal data collected on these legal grounds may be processed and transferred within the scope of the personal data processing conditions and purposes set out in Articles 5 and 6 of the KVKK, for the purposes specified in sections (1) and (2) of this notice.

4.Rights of the Data Subject

Pursuant to Article 11 of the KVKK;

1. To learn whether personal data is being processed,
2. To request information if personal data has been processed,
3. To learn the purpose of processing personal data and whether they are used in accordance with that purpose,
4. To learn the third parties to whom personal data is transferred, domestically or abroad,
5. To request the correction of personal data if it is incomplete or incorrectly processed,
6. To request the deletion or destruction of personal data within the framework of the conditions set out in Article 7 of the Law No. 6698 on the Protection of Personal Data (in particular where the reasons requiring the processing of personal data have ceased to exist, despite having been processed in accordance with the law),
7. To request that the actions carried out pursuant to subparagraphs (d) and (e) be notified to third parties to whom personal data has been transferred,
8. To object to the emergence of a result against the individual through the analysis of processed data exclusively by automated systems,
9. To request compensation for damages in the event of suffering harm due to the unlawful processing of personal data, you have the right to do so.

As data subjects, if you submit your requests regarding your rights to our Company through the methods set out below in this Personal Data Processing Information Notice, your request will be concluded free of charge within thirty (30) days at the latest, depending on the nature of the request. However, if a fee is determined by the Personal Data Protection Board, the fee set out in the applicable tariff will be charged by our Company.

Pursuant to Article 13, paragraph 1 of the KVKK, you may submit your requests regarding the exercise of your rights to our Company in writing or through other methods determined by the Personal Data Protection Authority (Data Protection Board).

You may submit your request containing explanations regarding the right you wish to exercise under Article 11 of the KVKK to our Company via the email address ik@hid-tek.com.tr.

Pursuant to Article 4 of the KVKK, HİD-TEK is obliged to keep your personal data accurate and up to date when necessary. In this context, in order for HİD-TEK to fulfill its obligations arising from applicable legislation, our customers are required to provide accurate and, when necessary, up-to-date information to HİD-TEK.
